Terms of Service

These Terms of Service (the "Terms") govern your use of the iOS application "Focuro" (the "App") provided by Shoichi Taguchi (the "Developer"). By downloading, installing, or using the App, you (the "User") agree to be bound by these Terms.
Note: These Terms are written primarily for users in Japan. The Japanese version is the original; this English translation is provided for convenience. In case of any conflict, the Japanese version prevails.
1. Application
- These Terms govern all matters relating to the use of the App between the User and the Developer.
- Any additional terms or guidelines that the Developer may post within the App from time to time form part of these Terms.
2. Eligibility
- The App is intended primarily for learners aged 13 or older in Japan, including junior high school students, high school students, university entrance exam candidates, university students, and graduate students.
- Users under 13 must obtain the consent of a parent or guardian and use the App together with parental controls such as Apple Family Sharing or Screen Time.
- Users use the App at their own risk and judgment.
3. Fees
- The App is currently provided free of charge.
- The Developer may add paid features (such as subscriptions) in the future. In such cases, the price, billing period, conditions of automatic renewal, cancellation methods, and conditions of any free trial will be clearly displayed within the App, and billing will commence only after the User's consent.
- Where in-app purchases are processed through the App Store, the terms and refund policy of Apple Inc. apply.
4. Required Permissions
- The core functionality of the App relies on Apple's Screen Time API. To use these features, the User must grant the relevant permissions through the device settings and the permission dialogs shown when the App is first launched.
- To use notification features, the User must grant notification permission. If permission is not granted, the User can still use the core functionality of the App, but reminders and session-completion notifications will not be delivered.
- To use iCloud sync, the device must be signed in to iCloud.
5. Provided Features
The App is intended to support the User's focused study and provides the following features.
- Blocking settings for SNS and other apps (full block / time limit)
- Block schedules (specified by day of week and time range)
- A focus timer (Pomodoro style)
- Usage time reports
- Exam date countdown
- Streaks (consecutive achievement days) and achievement badges
- Home Screen and Lock Screen widgets
- Cross-device data sync via iCloud
6. User Responsibility
- The User is solely responsible for the User's own configuration of the App (block targets, schedules, goals, etc.).
- The blocking features of the App operate based on the specifications of Apple's Screen Time API. Depending on the OS version or device state, blocking may not function as expected.
- The App does not guarantee any particular learning outcome or examination result.
- The User must not use the App for any of the following purposes:
- Purposes that violate laws, regulations, or public order and morals
- Purposes that infringe on the rights or interests of others
- Reverse engineering, modification, or redistribution of the App, except to the extent permitted by applicable law
7. Handling of Data
- The types of data handled by the App and the policy for their handling are set forth separately in the Privacy Policy.
- The App does not transmit User-entered data, history, exam goals, or other primary data to any servers operated by the Developer. For the purpose of improving the quality of the App and understanding usage trends, the App may send anonymous usage statistics to multiple third-party analytics service providers. 8. Intellectual Property
- The intellectual property rights in the App and its components, including its design, source code, mascot characters, and icons, belong to the Developer or other rightful owners.
- Users may not duplicate, redistribute, modify, or republish components of the App beyond the scope necessary for non-commercial, personal use.
9. Modification or Suspension of the Service
- The Developer may, within a reasonable scope, modify, add to, or discontinue the contents of the App. When making material changes, the Developer will provide advance notice within the App or at a location designated by the Developer.
- The Developer may suspend or interrupt the provision of the App without prior notice to Users in the following cases:
- When performing maintenance on the App
- When the provision of the App becomes difficult due to events of force majeure such as earthquake, fire, or power outage
- When the Developer otherwise determines that the provision of the App is difficult
- The Developer's liability for any loss or damage suffered by Users in connection with the modification, suspension, or termination of the App is limited as set forth in Article 10 (Disclaimers).
10. Disclaimers
- The App is provided "as is," without warranty of any kind, whether express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement of third-party rights.
- The Developer shall not be liable for damages incurred by Users or third parties as a result of the use of the App, except in cases of the Developer's intentional misconduct or gross negligence. Where these Terms qualify as a consumer contract under the Consumer Contract Act of Japan, the Developer's liability for damages caused by ordinary negligence shall be limited to the direct and ordinary damages actually suffered by the User, and shall not exceed the total amount paid by the User to the App in the past 12 months (which is JPY 0 for periods during which the App is used free of charge).
- The Developer shall not be liable for any failure of the App to function properly due to specification changes or service disruptions of the OS, Screen Time API, iCloud, or other services provided by Apple Inc., except in cases of the Developer's intentional misconduct or gross negligence.
11. Changes to These Terms
- The Developer may modify these Terms within a reasonable scope, in accordance with Article 548-4 of the Civil Code of Japan.
- When changes are made, the Developer will publish the contents of the changes and the effective date within the App or at a location designated by the Developer. For changes that are unfavorable to Users, a reasonable notice period will be provided before the effective date.
- If the User continues to use the App after the effective date of the changes, the User shall be deemed to have agreed to the modified Terms.
12. Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- In the event of any dispute arising between the User and the Developer in connection with the App or these Terms, the Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction as the court of first instance, except where mandatory provisions, including those of the Consumer Contract Act of Japan, prescribe otherwise.
